terms of service
The rules for using this website, our apps on the Shopify App Store, and work you hire us for directly. Plain English, as short as we could make it.
who these apply to
StoreSmith (“we”, “us”) builds and runs Shopify apps and delivers engineering work for Shopify merchants. “You” means the person or business using what we provide.
- this website
- Anyone who visits storesmith.dev or sends us a message through it.
- shopify apps
- Any store that installs a StoreSmith app from the Shopify App Store, and the staff who use it.
- client work
- Businesses that hire us directly for builds, retainers or fixes.
For client work, the statement of work or agreement you sign with us takes precedence over these terms wherever the two differ. Where an app listing says something more specific about that app, the listing wins for that app. By using the website, installing an app or approving work, you agree to these terms.
using this website
- Use the site for its purpose: reading about our work and getting in touch.
- Don’t try to break, overload or get unauthorised access to the site or its forms, and don’t use them to send spam.
- Articles, the diff and the blog are general information, not advice for your particular store. Check before you act on them.
- Store Health is in development. When it launches, it will read only what any visitor to your store can see. Only run it on stores you own or work on.
How we handle data from the site is in our privacy policy.
shopify apps
- installing
- Our apps are installed through Shopify. You approve the data each app can access before installing. Shopify’s own terms apply to your store and to the App Store as well as these.
- billing
- Paid plans are billed by Shopify, on your Shopify invoice. Plans, price changes, cancelling and refunds are covered in our billing policy.
- your licence
- While an app is installed, you may use it for your store’s business. The app itself, and its code, stay ours.
- your data
- Your store’s data stays yours. We process it only to run the app for you, as set out in our privacy policy.
- availability
- We work to keep every app running and fix faults quickly, but we don’t guarantee uninterrupted service or a set uptime unless we’ve agreed one with you in writing. Apps depend on Shopify and other providers we don’t control.
- support
- Through the app and its App Store listing. We answer every request; response times depend on the app and plan.
- changes
- Apps change as Shopify changes. We may add, change or retire features. If a change removes something you rely on or retires an app, we tell you ahead in the app or by email.
acceptable use
- Use our apps lawfully and within Shopify’s terms.
- Don’t copy, resell, reverse engineer or try to get around an app’s plan limits or billing.
- Don’t use an app to process data you have no right to process, or to send unlawful content.
- Don’t interfere with the app or the systems it runs on, or with other stores using it.
If an install breaks these rules, we may suspend it. Unless the problem is urgent or unlawful, we tell you first and give you a chance to fix it.
client work
Builds, retainers and fixes you hire us for directly. Your statement of work or agreement sets the detail; this section sets the defaults.
how work is agreed
- Every piece of work starts with a written spec and a quote. Nothing starts until you approve both in writing.
- If the scope changes, the spec and quote change in writing first. We don’t bill for work you didn’t approve.
- You give us the access we need — collaborator or staff accounts you control — plus information and timely feedback. Delays on either side move dates.
who owns the work
- The code and the repo are yours. Once you’ve paid for a piece of work, everything we wrote for it, and the repository it lives in, belongs to you.
- Open-source libraries and third-party tools in your code stay under their own licences.
- General know-how, and any tools or components we built before or outside your project, stay ours. Where they’re part of your delivery, you get a permanent licence to use them in your stores and systems.
- Our apps from the App Store are not client work. Using one in your project doesn’t transfer it to you.
- Unless you tell us not to, we may describe the work in anonymised form — your industry and the pattern, never your name or figures.
repair guarantee
If something we merged regresses within 90 days of going live, we repair it free. The guarantee doesn’t cover:
- changes made to that code by you or anyone else after we handed it over;
- problems caused by Shopify platform changes, third-party apps or services, or your hosting, after we delivered;
- new features, or anything that wasn’t in the approved spec;
- work that wasn’t deployed the way we delivered it.
Repairs are never invoiced. Anything outside the guarantee we quote first, like any other fix.
confidentiality
We keep your business information, code and data confidential and use them only for your work. We can sign an NDA or a data processing agreement if you need one.
payment
How we bill — Shopify billing for apps, invoices for direct work — plus payment terms, refunds and cancelling are all in our billing policy. It forms part of these terms.
our content
The StoreSmith name, logo, website design and the writing on this site are ours. You can quote and link to our articles with credit. Please don’t copy them wholesale or present them as your own. Shopify and other product names belong to their owners; we’re an independent studio and mention them only to describe our work.
third-party services
Our apps and our work connect to services we don’t run: Shopify above all, and systems you choose to connect, such as a CRM, POS, ERP or carrier. Their terms apply to your use of them, and we aren’t responsible for their outages, changes or decisions. Links from this site to other sites are for convenience only.
disclaimers
We build carefully and stand behind our work with the repair guarantee above. Beyond what these terms or your agreement promise, our website, apps and reports are provided “as is”. We don’t promise specific sales, conversion or performance results. Nothing here limits rights you have by law that can’t be limited.
limitation of liability
- We aren’t liable for indirect or consequential loss, including lost profits, revenue, sales or data, however it arises.
- For an app, our total liability is limited to what you paid for that app in the 12 months before the claim.
- For client work, our total liability is limited to what you paid under the relevant statement of work, unless that agreement sets a different limit.
- None of this limits liability for fraud, or for anything else the law doesn’t allow us to limit.
termination
- Apps: uninstall at any time. That ends the app terms for your store. What happens to your data is in our privacy policy.
- Client work: retainers and sprints end as set out in our billing policy and your agreement. Work you’ve paid for stays yours.
- We may suspend or end access if these terms are seriously broken, or if Shopify or the law requires it. Where we can, we tell you first.
- Sections that by their nature should continue — ownership, confidentiality, payment owed, limitation of liability — survive the end of these terms.
governing law
These terms are governed by the laws of [jurisdiction to be confirmed], and disputes go to its courts, unless your agreement with us says otherwise. Before any of that, tell us what’s wrong. Most problems are solved faster by talking.
changes
If we change these terms in a way that matters, we update the date at the top and tell app users in the app or by email before the change takes effect. Signed agreements change only in writing, agreed by both sides.
